These Terms of Service (“Terms”) govern your use of the Upzy mobile app. By downloading, installing, or using Upzy you agree to these Terms. If you do not agree, do not use the app.
1. The service
Upzy is an alarm clock and morning-routine app that requires you to complete missions (such as math problems, walking steps, or scanning a QR code) to dismiss alarms. Some features are free and some require a paid subscription.
2. Eligibility
You must be at least 13 years old (or the minimum digital-consent age in your country) to use Upzy. By creating an account you represent that you meet this requirement.
3. Account
You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately at the contact email below if you suspect unauthorized use.
4. Subscriptions and payments
Upzy offers auto-renewing subscriptions billed through your Apple ID. The subscription length, price, and free-trial period are shown on the in-app paywall before you confirm the purchase.
Payment is charged to your Apple ID at confirmation. The subscription automatically renews at the same price unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID settings.
Refunds are handled by Apple according to their App Store policy. We are not able to issue refunds directly.
Free trials, if offered, convert into a paid subscription unless you cancel before the trial ends. We will remind you in-app before any trial ends.
5. Acceptable use
You agree not to misuse the service, including by reverse engineering the app, attempting to bypass paywalls, abusing referral programs, or using the app to harass other users (for example through accountability invites). We may suspend or terminate accounts that violate these rules.
6. Alarm reliability disclaimer
Upzy uses the operating system’s alarm and notification systems to wake you up. While we work hard to make alarms reliable, we cannot guarantee that an alarm will always fire on time. Reasons include device-level Do Not Disturb, low battery, force-quitting the app, OS bugs, or other system limitations. Do not rely on Upzy as the sole alarm for safety-critical situations such as medical schedules or operating heavy machinery.
7. Health and physical activity
Some missions ask you to perform physical activity (push-ups, squats, walking). You participate at your own risk and should consult a healthcare provider before starting any new physical activity. Do not perform missions if you are injured or if it is unsafe to do so.
8. User content
You retain ownership of any content you submit (for example, alarm labels or QR codes). You grant us a limited license to store and process that content solely to provide the service.
9. Intellectual property
The Upzy app, its branding, and its content are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without permission.
10. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Upzy and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the service. Our total liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months before the claim.
12. Termination
You may stop using Upzy at any time and delete your account from Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the service.
13. Governing law
These Terms are governed by the laws of your country of residence to the extent required by local law, and otherwise by the laws of the jurisdiction where the developer is established. Disputes will be resolved in the competent courts of that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the latest version. Continued use of the app after changes constitutes acceptance of the new Terms.
